OVERVIEW
This website is operated by Les Habitudes LLC, doing business as LES HABITUDES. Throughout the site, the terms “we,” “us,” and “our” refer to LES HABITUDES.
These Terms of Service govern your access to and use of our website, online store, products, content, and related services (collectively, the “Services”).
Our store is powered by Shopify, which enables us to provide the Services to you.
By accessing, browsing, or using the Services, or by placing an order, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.
1. ACCESS AND USE
You must be at least the age of majority in your state, province, or jurisdiction of residence to make a purchase through the Services.
You agree to provide accurate, current, and complete information when placing an order or otherwise using the Services.
If you create a customer account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You may use the Services only for lawful purposes and in accordance with these Terms.
2. VINTAGE, ARCHIVAL, AND ONE-OF-ONE PRODUCTS
Much of the LES HABITUDES inventory consists of vintage, archival, deadstock, one-of-one, or delicately constructed garments and accessories.
Because of the age and nature of these pieces, minor variations, signs of age, or characteristics associated with long-term storage may be present. We make reasonable efforts to identify and disclose notable condition issues when known.
Product photographs, descriptions, measurements, dates, materials, and other details are provided in good faith and to the best of our knowledge. Measurements are approximate.
Colors and appearance may vary depending on lighting, photography, display settings, and the device used to view the Services.
If you need additional measurements, photographs, condition information, or other details, please contact us before purchasing.
3. AVAILABILITY
Many products are one-of-one or available in extremely limited quantities.
Adding an item to your cart does not reserve it. Products remain available for purchase until an order has been successfully completed and accepted.
We reserve the right to correct inventory errors, discontinue products, limit quantities, or cancel an order when an item is unavailable.
4. ORDERS
Submitting an order constitutes an offer to purchase.
We reserve the right to accept, decline, or cancel an order for reasons including product availability, suspected fraud, payment issues, pricing or listing errors, or other circumstances reasonably affecting our ability to fulfill the order.
If we cancel an order after payment has been processed, the amount paid for the canceled item or order will be refunded to the original payment method.
Please review your order carefully before submitting it. Once an order has been accepted, cancellation requests generally cannot be accommodated.
5. PRICING AND PAYMENT
Unless otherwise stated, prices are displayed in U.S. dollars.
Prices, markdowns, and availability may change without notice. The price charged will be the price shown when the order is placed, subject to correction of obvious pricing or technical errors.
Applicable taxes and shipping charges are calculated or disclosed during checkout as applicable.
You represent that you are authorized to use the payment method submitted with your order and that the billing information you provide is accurate.
6. FINAL SALE / RETURNS AND REFUNDS
Due to the vintage, archival, deadstock, and often one-of-one nature of our inventory, all sales are final.
We do not accept post-purchase cancellations, returns, refunds, or exchanges based on change of mind, fit, color, preference, or similar reasons.
Please review product descriptions, photographs, available measurements, and condition information carefully before purchasing.
If you receive the wrong item, or an item arrives damaged or materially different from its description, contact us promptly at contact@leshabitudes.com with your order number and supporting photographs so that we can review the issue.
Our final-sale policy does not limit any consumer rights or remedies that cannot lawfully be waived. Federal consumer-protection guidance recognizes separate issues where merchandise is damaged, defective, or different from what was ordered.

7. SHIPPING AND DELIVERY
Orders placed directly through our website are currently available for delivery within the United States.
Orders are typically processed and shipped within three business days unless otherwise stated. Tracking information is provided once an order has shipped.
Delivery dates and transit times are estimates and are not guaranteed. Carrier delays, weather, customs processing, and other circumstances outside our reasonable control may affect delivery.
International orders cannot currently be completed directly through website checkout. International clients may contact us to discuss shipping arrangements. International customers are responsible for applicable customs duties, VAT, import taxes, and other charges imposed by their destination country.

Nothing in this section limits rights or remedies provided by applicable law.
8. APPOINTMENTS
The LES HABITUDES archive may be viewed in person by confirmed appointment.
Appointment requests are subject to availability and are not confirmed until you receive confirmation from us.
Unless we expressly agree otherwise in writing, requesting or scheduling an appointment does not reserve or hold merchandise. Items may remain available for purchase online or by other clients.
Purchases made during appointments are subject to our final-sale policy unless otherwise expressly stated.
9. INTELLECTUAL PROPERTY
The Services and their contents—including the LES HABITUDES name, logos, graphics, photography, video, editorial imagery, product descriptions, text, designs, layout, and other original content—are owned by or licensed to LES HABITUDES and are protected by applicable intellectual-property laws.
You may use the Services for personal, non-commercial purposes only.
You may not reproduce, copy, distribute, modify, publish, commercially exploit, scrape, or otherwise use our original content without prior written permission.
Third-party designer names and trademarks appearing on the Services remain the property of their respective owners.
10. THIRD-PARTY SERVICES AND LINKS
The Services may contain links to or integrations with third-party websites, payment providers, social platforms, shipping providers, or other services.
We are not responsible for the content, availability, privacy practices, policies, products, or services of third parties. Your use of third-party services may be governed by separate terms and policies.
11. RELATIONSHIP WITH SHOPIFY
LES HABITUDES is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with LES HABITUDES.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and LES HABITUDES, including injury, damage, or loss resulting from purchased products or services. You release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with LES HABITUDES.
12. PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, certain personal information is also processed by Shopify and other service providers in order to operate our store, process transactions, provide functionality, prevent fraud, and support the Services.

13. ERRORS AND INACCURACIES
Occasionally, information on the Services may contain typographical errors, inaccuracies, omissions, incorrect pricing, incorrect availability, or other mistakes.
We reserve the right to correct such information, update the Services, or cancel an affected order where appropriate.
If an order is canceled because of an error after payment has been processed, the amount paid for the canceled item or order will be refunded.
14. PROHIBITED USES
You may not use the Services:
- for unlawful or fraudulent purposes;
- to infringe intellectual-property, privacy, or other rights;
- to transmit malicious code or interfere with the operation or security of the Services;
- to impersonate another person or provide intentionally false information;
- to harvest personal information from other users;
- to send spam or unauthorized solicitations;
- to circumvent security, access restrictions, or technological protections; or
- to reproduce, scrape, extract, or commercially exploit substantial portions of the Services without authorization.
We may restrict or terminate access where we reasonably believe these Terms have been violated.
15. FEEDBACK AND SUBMISSIONS
If you voluntarily submit reviews, photographs, feedback, suggestions, or other content to us, you represent that you have the right to provide that material.
Unless otherwise agreed in writing, you grant us a non-exclusive, worldwide, royalty-free right to use submitted reviews or feedback in connection with operating, improving, or promoting the Services.
We are not obligated to publish or retain any submission.
16. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.
We do not guarantee that access to the Services will always be uninterrupted, secure, or error-free.
Vintage and archival goods may naturally differ from newly manufactured merchandise because of their age, materials, construction, storage history, or prior handling.
Nothing in these Terms excludes or limits any warranty, consumer protection, or other right that cannot legally be excluded.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Les Habitudes LLC, LES HABITUDES, and our officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Services or products purchased through the Services.
Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.
18. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Les Habitudes LLC, LES HABITUDES, Shopify, and our respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims arising from your material breach of these Terms, violation of applicable law, or infringement of another party's rights.
19. TERMINATION
We may suspend or terminate access to the Services if you violate these Terms or misuse the Services.
Provisions that by their nature should survive termination—including intellectual-property, limitation-of-liability, indemnification, and governing-law provisions—will remain in effect.
20. SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the greatest extent permitted by law and severed where necessary. The remaining provisions will remain in effect.
21. WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies referenced on the Services, constitute the agreement governing your use of the Services.
22. ASSIGNMENT
You may not assign your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other lawful transfer of the business.
23. GOVERNING LAW
These Terms and your use of the Services are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Any dispute will be subject to the jurisdiction of courts having lawful authority over the dispute.

We may update these Terms from time to time.
The current version will be posted on this page with the updated revision date. Where required by law, we will provide additional notice of material changes.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
